1. Introduction

Important Notice: The brand “BNK” is our corporate identifier. We do not provide banking, financial, loan, or investment services. We operate exclusively as an IT and software development enterprise.

Because our primary business involves creating, deploying, and managing digital creations, protecting Intellectual Property (IP) is central to our operations. This Intellectual Property Policy defines the ownership, usage rights, and licensing terms for all digital assets produced, hosted, or managed by BNK Services.

2. Purpose

The purpose of this Intellectual Property Policy is to provide absolute clarity regarding who owns what. It ensures that the creative, technical, and strategic work produced by BNK Services is legally protected from unauthorized duplication or theft, while simultaneously guaranteeing that our clients receive the full legal ownership of the bespoke software products they commission.

3. Scope

This policy governs the intellectual property rights associated with:

  • The BNK Services website, including its content, layout, and visual design.
  • Custom source code, databases, and APIs developed for our clients.
  • Logos, graphics, UI/UX designs, and brand assets.
  • Trademarks, service marks, and trade names used by the Company.

4. Definitions

  • Intellectual Property (IP): Intangible property that is the result of creativity, such as patents, copyrights, trademarks, and trade secrets.
  • Source Code: The fundamental, human-readable text written in programming languages that dictates how a software application functions.
  • Deliverables: The finalized, fully compiled software, designs, or technical documentation handed over to a client at the end of a project.
  • Open Source: Software with source code that anyone can inspect, modify, and enhance, usually governed by specific public licenses (e.g., MIT, GPL).

5. Company Ownership (What Belongs to Us)

5.1 Website Content and Design

All content present on the BNK Services website (https://www.bnkservices.in) is the exclusive property of the Company. This includes, but is not limited to:

  • Written copy, blog posts, and technical articles.
  • Website architecture, HTML/CSS structure, and UI/UX design.
  • Custom graphics, animations, and visual layouts. You may not scrape, copy, reproduce, or republish our website content without express written permission.

5.2 Proprietary Frameworks and Internal Tools

Over years of development, BNK Services has created internal libraries, proprietary frameworks, and boilerplate code architectures that allow us to build software rapidly and securely. We retain full, exclusive ownership of these pre-existing background technologies. When these are used in a client project, the client is granted a perpetual, non-exclusive license to use them as part of the final Deliverable, but the client does not own the underlying framework itself.

5.3 Trademarks and Logos

The “BNK Services” name, the BNK logo, and all related brand graphics are registered trademarks or trade dress of the Company. You may not use our trademarks in connection with any product or service that is not ours, or in any manner that is likely to cause confusion among customers.

6. Client Ownership (What Belongs to You)

We believe that when you pay for custom software development, you should own the end product.

6.1 Custom Source Code

Upon the successful completion of a project and the receipt of final and full payment, BNK Services fully transfers the intellectual property rights and copyright of the custom-developed application logic to you, the Client. You are free to modify, distribute, sell, or patent the final bespoke software as you see fit.

6.2 Client Assets

Any logos, graphics, databases, or content that you provide to us to be incorporated into your software project remain your exclusive intellectual property. By providing these assets to BNK Services, you grant us a temporary, limited license to use them solely for the purpose of completing your project.

7. Licensing

7.1 Software Licenses

In cases where BNK Services provides access to hosted SaaS (Software as a Service) platforms or subscription-based SEO tools, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the software for its intended purpose. You do not gain ownership of the underlying code of our SaaS products.

7.2 Open Source Software

Modern software development frequently utilizes open-source libraries. Whenever BNK Services incorporates open-source code into your project, we do so in strict compliance with the respective open-source licenses (e.g., MIT, Apache 2.0). The ownership of those specific open-source components remains with their original creators.

BNK Services respects the intellectual property rights of others. If you believe that your copyrighted work has been copied or hosted on our infrastructure in a way that constitutes copyright infringement, please notify our legal team immediately. Your notification must include:

  • A physical or electronic signature of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed.
  • A description of where the material is located on our site or servers.
  • Your contact information (email, phone number, address).

Upon receiving a valid infringement notice, we will investigate and, if necessary, expeditiously remove or disable access to the infringing material.

9. User Responsibilities

As a user of our website or a client of our software development services, it is your responsibility to:

  • Ensure that any materials, designs, or data you hand over to BNK Services for integration into your project do not infringe upon the intellectual property rights of any third party.
  • Refrain from reverse engineering, decompiling, or attempting to extract the source code of our proprietary SaaS tools or website.
  • Respect our trademarks and avoid using our logo without formal authorization.

10. Company Responsibilities

BNK Services is responsible for:

  • Ensuring that the custom code we write for you is original and free from unauthorized third-party IP encumbrances.
  • Formally executing the transfer of IP rights to you upon project completion and final payment.
  • Protecting your proprietary business logic and trade secrets discussed during the development process through strict confidentiality practices.

11. Governing Law

This Intellectual Property Policy shall be governed by and construed in accordance with the laws of India. Any legal disputes regarding copyright ownership, trademark infringement, or software licensing shall be subject to the exclusive jurisdiction of the competent courts in our operational area.

12. Updates to Policy

Intellectual property law, particularly in the technology sector, is subject to frequent change. We reserve the right to update or modify this Intellectual Property Policy at any time.
